While we are aware most of our customers have a good understanding of CBD, some people still ask us, “Is CBD oil legal in Ireland?”. Given that CBD comes from the hemp plant, there is a lot of confusion out there, and many mistake it for cannabis, leading to questions about its legal status. In addition, laws and regulations are ever changing and it’s only right to make sure CBD is legal in Ireland in 2022.

Not to worry, though; we are here to answer all your questions about CBD’s legal status in Ireland and the other countries we ship to across the globe. Additionally, we will shed some light on the differences between cannabis and CBD and where to buy CBD oil in Ireland and abroad.

CBD vs. cannabis

Before we jump into answering is CBD oil legal in Ireland, it seems only right to address the elephant in the room: cannabis. Although some are entirely aware of the differences between marijuana and CBD, others have yet to distinguish. And who can blame them when the information around CBD is often either technical or focusing entirely on benefits. (Feel free to skip this part if you know the difference between CBD and cannabis).

If you are unsure of the distinction, CBD is one of the many chemical compounds, or as it is often called, ‘cannabinoids’ extracted from the cannabis Sativa plant. Naturally, cannabis also comes from this plant and this causes quite a bit of confusion.

However, CBD has trace amounts of THC, the psychoactive element that gives users a euphoric feeling. By contrast, cannabis has significant amounts of THC, which explains why those who smoke it get high. In addition to this high feeling, those who smoke cannabis may experience other hallucinogenic effects.

While cannabis is strictly illegal in the vast majority of countries, CBD is considered a food supplement and is, for the most part, legal to sell, buy and consume. This is so long as it meets specific requirements, which we will delve into later.

Overall, CBD has been implemented into the lives of many who seek to enhance their physical and mental wellness. While there has been some research into the benefits of CBD, it is still limited, and a lot of the benefits that have been reported are the result of anecdotal claims.

Is CBD oil legal in Ireland?

Let’s get straight into what you want to know now: is CBD oil legal in Ireland? The answer is, yes, CBD oil is legal to sell, buy and use in Ireland. CBD does not fall under the Misuse of Drugs legislation in Ireland and is not considered a controlled substance. This is because CBD is not psychoactive.

For CBD products to be legally sold in Ireland, they cannot contain THC. Although, CBD products do often find themselves in a legal gray area in Ireland since they generally fall under the European Novel Food Regulation. This regulation is in place by the EU and controls the placement of CBD products and other various novel foods for sale. Novel foods are considered foods that do not have a long history of consumption.

Novel foods are also products that are altered, for example, changed by using heat or by incorporating additives. In order words, the product is entirely changed. Depending on the extraction method, this is why a lot of CBD products do fall under the Novel Foods bracket. However, Greenheart’s CBD oil does not and is considered a novel food. The reason for this is that we extract CBD using cold-press extraction and this does not alter the product.

There are numerous different extraction methods out there when it comes to creating CBD products, but our method is incredibly efficient and the most natural. It means all parts of the hemp plant are incorporated and pressed. Then, the raw CBD oil is collected, making a high-quality product without using any solvents or chemicals. Beyond being natural, this also ensures our CBD oil is zero waste, making it eco-friendly.

The United States Federal Law allows CBD to be extracted from hemp and used in products so long as they do not exceed 0.3% THC. In saying that, each state has its own say and, therefore, its own legislation. The states are generally categorized by colors: Green, Amber, Amber-Red, and Red.

Green refers to states where cannabis is legalized, so CBD is too. Amber states are those where CBD can be sold but has specific conditions. Amber-red states are those where CBD is legal but more conditions are added. Finally, as the name implies, red states are states where CBD is illegal.

Some examples of green states include Colorado, California, Alaska, Massachusetts, Maine, Michigan, Nevada, Oregon, Washington, and Vermont. These are the states where CBD is entirely legal. For the amber states, you will likely require a prescription. Amber-red states means the products generally have a very low THC content and are mainly encouraged for medical purposes.

However, it is important to regularly check on your country or state’s laws to confirm whether CBD oil is legal. This is because the laws are ever changing as more research is conducted and there is more awareness of CBD.
